COUNT I — SEXUAL MISCONDUCT WITH A MINOR (LEVEL 4 FELONY) Ic 35-42-4—9 (1) On or about July 20, 201 in Clark County, State of Indiana, Timothy Paul Douglas Samples, a person over twenty—one (21) years of age, did with S.M., a person at least fourteen (14) years of age but less than sixteen (16) years of age, preform or submit to sexual intercourse of deviate sexual conduct

Today: the initial investigating officer testified as to how the case got started.  Then the State called Det. Isaac Parker who testified as to the course of the investigation. parker Parker is an excellent detective and a formidable adversary for the defense.  He is trained in interrogation techniques that are well conducted by his technique of ‘finding common ground’ with the suspect…no matter how heinous their crime.  Woe unto the guilty man or woman who faces him!    In this case Parker testified that Samples was contacted and voluntarily came to the police station and gave an interview to Parker ….during the course of which, Parker claims Samples admitted to having a sexual relationship with the S.M.  It was thereafter that Samples clammed up and asked for an attorney.

Well, that was a good move, but it was a little late.  Parker also said that the victim’s underwear was examined but no ‘seminal fluid’ was found but, that dna material was. (Huh?).  Parker said he did not follow up with DNA testing to see if it was Samples because he already had Samples’ admission.  (A decision Gawnews thinks may come back to haunt him)  He described this decision as “Why get a maternity test after the birth”?

At press time, the court had adjourned the jury to deal with ‘techincal issues’. ( Probably how to present the video tape of the Interview.)

Tell 'em how you really feel
